do hereby agree to buy the above mentioned Canine, and agree to the following
terms and conditions:
The Breeder guarantees that the
above named canine is in good health at the time of the sale, (Veterinarian
Checked no more than 5 days before leaving Sellers possession) and embodies the
characteristics of the breed named above.
This canine is purebred with AKC registered parents. Great care is exercised by the breeder to
prevent or eliminate parasites, however, since these are quite common among
animals, we cannot guarantee any animal to be totally parasite or fungus free,
therefore, the Breeder’s guarantee does NOT cover any liability for any injury,
or illness caused by Parasites internal or external.
The Buyer is to have this
Canine checked by a Veterinarian of their choice within 72hours of
delivery. Failure to do so will void
this contract and its guarantees. Examination
should include a stool check for parasites.
If the Purchaser’s veterinarian finds cause for return of the puppy for
any non-treatable health reason, seller must be informed within 72 hours of
purchase. Seller’s veterinarian shall be
allowed to examine said puppy. Provided
both veterinarians agree that there is reasonable cause for the return of the
puppy due to non-treatable health reason which existed at the time of purchase,
and further provided that the puppy has been properly cared for while in
purchaser’s possession, seller will replace the puppy originally purchased with
another puppy of equal value when one is available. If the Canine is found to have a fatal or
severe life-altering genetic defect, by one year of age that is diagnosed by the
Buyers licensed veterinarian, the buyer has two business days to notify the
Breeder/Seller of these findings in writing, and the puppy will be returned to
the breeder within 10 days after said exam with appropriate documentation of
medical condition and registration papers.
In the event of the puppy’s death, a necropsy must be performed to
determine the cause of death. This exam
is done at the Seller’s expense. (Seller reserves right to choose independent
veterinarian to perform necropsy).
BREEDER/SELLER IS IN NO WAY RESPONSIBLE FOR PAYMENT OF ANY OTHER MEDICAL
OR VETERINARY EXPENSES. The Buyer
understands that the Breeder/Seller offers NO CASH REFUNDS. If the buyer qualifies for a puppy
replacement, then the purchase price will be put towards another Canine of
equal or lesser value when one becomes available, under no circumstances will
refunds be made in lieu of a replacement.
If Buyer rejects a replacement puppy, all sales become final. The Buyer is responsible for all expense in
the return of the Canine. Under NO
CONDITION will the breeder replace this canine, where the breeder was not
advised of its being ill beforehand, or “put to sleep” without the breeders
permission.
All age appropriate shots have
been given, and a record of vaccination history is supplied at the time of
delivery. Buyer understands that until a
puppy fully receives all age appropriate vaccinations, he remains susceptible
to many common diseases which are passed through contact with infected feces
and soil as well as airborne illnesses. Therefore,
until puppy has completed said vaccinations through 16 weeks, Buyer agrees to
make every attempt to not expose puppy to public areas that are trafficked by
other pets. Buyer further agrees to
maintain the Canine’s health in good condition, and to provide yearly
examinations, vaccinations, heartworm treatment and any other usual procedures
necessary to assure good health. The
Buyer agrees to provide a suitable and safe environment for this canine. Since, there are many factors that can
influence growth and development, such as diet, exercise, weight gain, etc, the Breeder/Seller offers no further
guarantees once care of the canine is no longer under their control, as to the
canine’s adult size, weight, hair coat, skin conditions, temperament, or
trainability.
The Breeder/Seller makes no warranties
or guarantees, express or implied, other than those written in this agreement
including, without limitation, the warranties of merchantability and
fitness. This document constitutes the
entire agreement between the Breeder/Seller and the Buyer with legal respect to
this sale. In the event of litigation of
any kind, Venue and Jurisdiction shall lie exclusively in the Breeder/Seller’s
court and state and any and all legal fees arising from said litigation shall
be paid in full by the Buyer.
